Has anyone heard anything back either way in response to a refund request for all the downtime last quarter?

I wasn't a part of asking for one, but I'm laughing at the 99.99% uptime on the status page that I know is not true.

OMG they seriously didn't update it. Straight up lying to their customers.

Are they supposed to give us a partial refund if they violate the uptime provision?

@Collin Hannah yes but you had to have sent it in already.

Short answer - if they violate the SLA they must refund you a month of service if you submit the appropriate request with documentation. That said, it is difficult to get them to actually do it, and their definition of uptime is a bit different than what we would think it should be.
They also give you a 5 day window for submitting the request each quarter.

I received a generic reply from the billing dept - Dear customer, This is to acknowledge that we have received your email. Per our SLC Statement, your request will be reviewed after the calendar quarter and we will respond accordingly.  For more information please reference the Oracle NetSuite Service Level Commitment http://www.netsuite.com/portal/resource/slc.shtml
