This was not a problem with the tool. And hence it was not addressed in the minor release of the tool. The relevant team is working on it and it will be fixed soon.

Hi I can tell you that I am working on a project that everyform I pull from sandbox has these <neverempty> tags on every field and they have to be removed from the XML before it will validate. So it does seem like a problem to me.

Yes i agree its a problem and the fix is already found by the relevant team and will be available in upcoming release hopefully.
