Is there a way to have a checkbox on a transaction that doesn't require to to be in edit mode to check the box?

No, but you could add a button with a workflow (or script) and have that trigger an update to a checkbox. This would allow you to maintain access levels of the users, but still allow controlled manipulation of the record. I assume this may be what you really seek.
